Zero hours contracts<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/staff\/what-is-a-zero-hour-contract\/\" data-type=\"knowledge\" data-id=\"1572\">zero hours contract<\/a> is a type of employment where <strong>the worker isn&#8217;t guaranteed a set number of hours<\/strong> by the employer. Staff on these contracts are <strong>only paid for the hours they work<\/strong>, so you have more flexibility if there\u2019s less work for them to do.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A zero hours contract allows the employer and temporary staff to have a more long-term agreement, even if the number of hours being worked is inconsistent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They also offer a more defined legal framework than other types of temporary employment, including measures such as performance reviews.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, new legislation as part of the <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/staff\/employment-rights-bill\/\" data-type=\"knowledge\" data-id=\"26327\">Employment Rights Bill<\/a> means employees can\u2019t be forced onto a zero hours contract and must be offered a guaranteed-hours contract based on previous hours worked.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"3agencyworkers\">3. Agency workers<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">You may choose to hire temp staff through a temporary work agency. This is particularly common in the retail and hospitality sectors. If you\u2019re hiring agency workers, you need to be aware of their rights under the <a href=\"https:\/\/www.gov.uk\/government\/publications\/agency-workers-regulations-2010-guidance-for-recruiters\" target=\"_blank\" rel=\"noreferrer noopener\" rel=\"noopener noreferrer\" target=\"_blank\">Agency Worker Regulations<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All agency workers are classed as \u2018workers\u2019, rather than employees. They\u2019re still entitled to things like paid annual leave, rest breaks, and the <a href=\"\/knowledge\/staff\/what-is-the-national-minimum-wage\/\" data-type=\"knowledge\" data-id=\"1588\">national minimum wage<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You\u2019ll also need to give them standard health and safety at work, and protection from unlawful wage deductions and discrimination as set out in the <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/staff\/worker-protection-act\/\" data-type=\"knowledge\" data-id=\"1585\">Equality Act 2010<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once an agency worker reaches 12 continuous weeks in a job, they have a right to the same treatment as comparable employees. This means you must treat them the same as if you&#8217;d hired them directly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This includes pay (as well as bonuses and commission), and working time rights on top of those guaranteed by law, such as paid leave.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"route\">Choose a hiring route<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Next, you need to choose whether you\u2019ll hire staff directly, through a recruitment agency, or through a temp agency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s important to note that temp agencies operate in a different way. For example, a specialist recruitment contractor is likely to cost more than a member of hospitality staff working at an event.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you decide to take on an agency worker as a permanent member of staff, you\u2019re likely to be charged a \u2018transfer fee\u2019.
