And what are the consequences for not properly following regulations?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"landlordboilerservicewhatthelawsays\">Boiler servicing responsibilities for landlords<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Landlords are legally responsible for repairs to heating, hot water, gas appliances, pipes, flues, ventilation, wiring, and sanitary fittings. This means boiler repairs and servicing is up to you.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s also the landlord\u2019s legal obligation to service any gas appliances with the frequency required by the manufacturer \u2013 you\u2019ll find this detailed in the product manual.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.legislation.gov.uk\/uksi\/1998\/2451\/contents\" rel=\"noopener noreferrer\" target=\"_blank\">Under the Gas Safety (installation and use) Regulations 1998<\/a>, landlords are legally required to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">complete an annual gas safety check \u2013 you must arrange for a gas safe registered engineer to carry out a gas safety check on the boiler and any other gas appliances every 12 months<\/li>\n\n\n\n<li class=\"wp-block-list-item\">gas safety certificate \u2013 after the inspection, you must provide your tenants with a copy of the Gas Safety Record (CP12 certificate) within 28 days, or before they move in\u00a0<\/li>\n\n\n\n<li class=\"wp-block-list-item\">ongoing maintenance \u2013 you must make sure the boiler is kept in safe working order through regular servicing and repair as required.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Not following the regulation can result in hefty fines, invalid insurance, and even criminal prosecution.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Who\u2019s responsible for servicing the boiler \u2013 landlords or tenants?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The landlord is responsible for servicing the boiler. But tenants generally assume responsibility for daily maintenance (but not repairs) like keeping the heating running when necessary and reporting problems.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some tenancy agreements can state the tenant is responsible for maintaining chimneys and flues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the only law requires an annual gas safety check, it\u2019s also best practice to arrange a full boiler service once a year. A service goes beyond basic safety checks and helps:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">improve efficiency and reduce energy bills for tenants<\/li>\n\n\n\n<li class=\"wp-block-list-item\">prolong the life of the boiler<\/li>\n\n\n\n<li class=\"wp-block-list-item\">prevent costly breakdowns and emergency call-outs<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">How long does a landlord have to fix a boiler?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Landlords are required to take action to repair any problems quickly. Section 11 of the Landlord and Tenant Act 1985 states that repairs should be carried out in a \u2018reasonable time\u2019.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Emergency repairs should be addressed within 24 hours as having no hot water or heating constitutes a hazard under the law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Access rights to the property for boiler checks<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You must give tenants at least 24 hours\u2019 written notice before entering the property to carry out a boiler service or repair (unless it\u2019s an emergency). Even though boiler checks are a legal requirement, <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/tenants\/guide-to-landlord-access-rights\/\" data-type=\"knowledge\" data-id=\"1013\" >regular access rights<\/a> still apply.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Energy efficiency responsibilities for landlords<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Landlords must make sure their rental properties meet a minimum Energy Performance Certificate (EPC) rating of E, according to an update to regulations in April 2020.
