{"id":952,"date":"2021-03-26T00:00:00","date_gmt":"2021-03-26T00:00:00","guid":{"rendered":"https:\/\/www.simplybusiness.co.uk\/knowledge\/articles\/what-is-private-residence-relief\/"},"modified":"2025-05-22T13:19:02","modified_gmt":"2025-05-22T13:19:02","slug":"what-is-private-residence-relief","status":"publish","type":"knowledge","link":"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-tax\/what-is-private-residence-relief\/","title":{"rendered":"What is Private Residence Relief?"},"content":{"rendered":"<p class=\"wp-block-paragraph\">You may be able to reduce the amount of capital gains tax you need to pay when selling a buy-to-let property.<\/p>\n\n<p class=\"wp-block-paragraph\">Here, our guide to Private Residence Relief for landlords explains how the relief works and what you could do to benefit.<\/p>\n\n<h2 class=\"wp-block-heading\">What is Private Residence Relief \u2013 and who\u2019s eligible?<\/h2>\n\n<p class=\"wp-block-paragraph\">Private Residence Relief (PRR) is a capital gains tax relief that\u2019s automatically applied when you sell a property.<\/p>\n\n<p class=\"wp-block-paragraph\">To benefit from the full relief, it must be your main home (you may also qualify when you dispose of a residence that you\u2019ve provided for a dependent relative).<\/p>\n\n<p class=\"wp-block-paragraph\">Whereas if you\u2019re selling a second home or buy-to-let property, you\u2019ll have to pay <a href=\"\/knowledge\/business-tax\/capital-gains-tax\/\" data-type=\"knowledge\" data-id=\"1361\" >capital gains tax<\/a> on property profits \u2013 but you might be able to get some relief depending on whether you\u2019ve ever lived in the property.<\/p>\n\n<p class=\"wp-block-paragraph\">You don\u2019t get any tax relief if you bought your property to make a gain \u2013 in other words, if you bought it as an investment or to use it for business.<\/p>\n\n<h2 id=\"taxwhenyousellyoursecondhome\" class=\"wp-block-heading\">Tax when you sell your second home<\/h2>\n\n<p class=\"wp-block-paragraph\">As mentioned above, when you sell a second home that\u2019s increased in value, you\u2019ve made a \u2018gain\u2019. HMRC sees the gain as taxable \u2013 this is capital gains tax.<\/p>\n\n<p class=\"wp-block-paragraph\">There are factors that might mean you can get some relief though:<\/p>\n\n<ul class=\"wp-block-list\"><li class=\"wp-block-list-item\">if the property was ever your main residence<\/li>\n\n<li class=\"wp-block-list-item\">if you let part or all of the property<\/li>\n\n<li class=\"wp-block-list-item\">whether you used the property for business (although a spare room as an office doesn\u2019t count here)<\/li>\n\n<li class=\"wp-block-list-item\">the grounds cover less than 5,000 square metres<\/li>\n\n<\/ul>\n\n<h2 id=\"howtocalculateprivateresidencerelief\" class=\"wp-block-heading\">How to calculate Private Residence Relief<\/h2>\n\n<p class=\"wp-block-paragraph\">So as a landlord, the relief you can get depends on the financial gain you make from selling your property and the amount of time you\u2019ve lived there.<\/p>\n<div id=\"nba-body-001\">\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">You\u2019ll always get full relief for:<\/p>\n\n<ul class=\"wp-block-list\"><li class=\"wp-block-list-item\">the years you lived in the home<\/li>\n\n<li class=\"wp-block-list-item\">the last nine months you owned the home \u2013 even if you weren&#8217;t living there at the time<\/li>\n\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">You buy your property for \u00a3190,000 and sell it six years later for \u00a3240,000 \u2013 making a taxable gain of \u00a350,000.<\/p>\n\n<p class=\"wp-block-paragraph\">You lived in the whole property for two years before letting it out. You\u2019ll be able to get relief on the time you lived there, plus nine months after you move out.<\/p>\n\n<p class=\"wp-block-paragraph\">You\u2019ll get Private Residence relief for the 33 months (46 per cent of the time) you lived in the property. So you\u2019ll get relief on 46 per cent of the gain, which is \u00a323,000.<\/p>\n\n<p class=\"wp-block-paragraph\">The remaining 54 per cent of the gain (\u00a327,000) isn\u2019t covered by Private Residence Relief, so this is your chargeable gain.<\/p>\n\n<p class=\"wp-block-paragraph\">The government has a <a href=\"https:\/\/www.gov.uk\/tax-relief-selling-home\" rel=\"noopener noreferrer\" target=\"_blank\">private residence relief calculator<\/a> to help you work out the tax you\u2019ll pay when you sell your home.<\/p>\n\n<h2 id=\"privateresidencerelief18monthsorninemonths\" class=\"wp-block-heading\">Private Residence Relief \u2013 18 months or nine months?<\/h2>\n\n<p class=\"wp-block-paragraph\">If you sold the property between 6 April 2014 and 6 April 2020, you get relief for the last 18 months you owned it.<\/p>\n\n<p class=\"wp-block-paragraph\">However since April last year, this relief is restricted to nine months after you move out.<\/p>\n\n<h2 id=\"canyouclaimbothprivateresidencereliefandlettingrelief\" class=\"wp-block-heading\">Can you claim both Private Residence Relief and Letting Relief?<\/h2>\n\n<p class=\"wp-block-paragraph\">Changes in April 2020 mean that only landlords who <strong>share an occupancy with tenants<\/strong> can get Letting Relief.<\/p>\n\n<p class=\"wp-block-paragraph\">As this only applies if you let out part of your home and are living there yourself as a main residence, you can get both Private Residence Relief and Letting Relief when you sell your home.<\/p>\n\n<p class=\"wp-block-paragraph\">To calculate Letting Relief, you\u2019ll need to work out the proportion of your home that\u2019s let out. If eligible, you can get up to \u00a340,000 in Letting Relief.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Example:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">You rent out one bedroom to a lodger. This amounts to 10 per cent of your home.<\/p>\n\n<p class=\"wp-block-paragraph\">You sell your property and make a chargeable gain of \u00a340,000. As you let out part of your main home, you\u2019ll get Private Residence Relief on 90 per cent of this gain (\u00a336,000).<\/p>\n\n<p class=\"wp-block-paragraph\">You\u2019re entitled to Letting Relief on the remaining gain (\u00a34,000). You won\u2019t have to pay any tax.<\/p>\n\n<h2 id=\"reportingtohmrc\" class=\"wp-block-heading\">Reporting to HMRC<\/h2>\n\n<p class=\"wp-block-paragraph\">Once you\u2019ve calculated any relief you\u2019re eligible for, you\u2019ll need to report any capital gains tax to HMRC by 31 January each year.
