This can be included in your tenancy agreement or given as a standalone document.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here\u2019s what needs to be in a written statement of terms and why you might need to give one to your tenant before 31 May 2026.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-a-written-statement-of-terms\">What is a written statement of terms?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Under the new Renters&#8217; Rights Act, the written statement of terms is a mandatory, standardised document that outlines the core conditions of an assured periodic tenancy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It doesn\u2019t replace your actual tenancy agreement but it\u2019s designed to sit alongside it. Its purpose is to make sure tenants are given a clear summary of their fundamental rights and responsibilities upfront before any contract is signed or the tenancy begins.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You can even make this a section in your tenancy agreement to reduce the amount of documentation you share.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-is-the-written-statement-of-terms-related-to-the-information-sheet\">Is the written statement of terms related to the information sheet?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s easy to get these documents confused. Both share the exact same goal \u2013 to make sure tenants clearly understand their rights, protections, and obligations under the new rules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, it\u2019s one or the other, never both. The documents are designed to be used in completely different scenarios:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>written statement of terms \u2013<\/strong> used to establish the rules from scratch. It\u2019s for <strong>new tenants<\/strong> (starting on or after 1 May 2026) or existing tenants who only have a verbal agreement<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>the information sheet<\/strong> \u2013 an explainer that\u2019s specifically for <strong>existing tenants<\/strong> who already signed a written contract before 1 May. It acts as a bridge to explain how the new Act legally modifies their current agreement<\/li>\n<\/ul>\n\n\n\n<div id=\"nba-body-001\">\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-the-written-statement-of-terms-works-for-new-tenancies\"><strong>How the written statement of terms works for new tenancies<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If you\u2019ve found a new tenant, you\u2019re legally required to provide the written statement of terms <strong>before<\/strong> the tenancy agreement is signed or the tenancy begins.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You can include all of the information for the written statement of terms directly within the contract itself, instead of issuing two separate documents.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-the-written-statement-of-terms-works-for-existing-tenancies-nbsp\"><strong>How the written statement of terms works for existing tenancies&nbsp;<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If your tenants have been in your property since before the 1 May rollout, you have a strict deadline of 31 May 2026 to provide them with the correct documentation. What you need to do depends on your current setup:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>for existing written agreements \u2013<\/strong> you <strong>don\u2019t<\/strong> need to draft a new written statement of terms. Instead, you must provide your tenants with a copy of the government-produced information sheet. This must be the exact PDF provided by the government, and you must send it (either printed out or digitally as an attachment) to every named tenant<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>for verbal agreements (unwritten tenancies) \u2013<\/strong> you must provide the full written statement of terms outlining the key conditions of their tenancy. They don\u2019t need the information sheet as your written terms will cover their new rights\u00a0<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-group has-azure-200-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-30c80bf8 wp-block-group-is-layout-constrained\" style=\"border-radius:10px;margin-top:var(--wp--preset--spacing--90);margin-bottom:var(--wp--preset--spacing--90);padding-top:var(--wp--preset--spacing--90);padding-right:var(--wp--preset--spacing--90);padding-bottom:var(--wp--preset--spacing--90);padding-left:var(--wp--preset--spacing--90)\">\n<h2 class=\"wp-block-heading\" id=\"h-what-s-included-in-the-written-statement-of-terms\">What\u2019s included in the written statement of terms?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The government has outlined what this document must contain. A basic summary is not enough and your statement must explicitly outline:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">the basics \u2013 include the full names of all landlords and tenants, the exact rental property address, and an address in England or Wales where tenants can serve formal legal notices to you<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the financials \u2013 the rent amount, the payment due date (rent periods can\u2019t exceed one month), and a statement confirming that future rent increases must use a formal Section 13 notice. You must also clarify if utility and council bills are included in the rent or paid separately<\/li>\n\n\n\n<li class=\"wp-block-list-item\">safety and repairs \u2013 clear statements acknowledging your legal duty to make sure the property is fit for human habitation.
