For landlords, the shift isn\u2019t just about new rules \u2013 it\u2019s about a fundamental change in how tenancy agreements are written and managed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Assured shorthold tenancies will be replaced by a single system of periodic tenancies from 1 May 2026. This means issuing a specific notice to existing tenants and a new written statement for new tenancies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Find out the latest government guidance for tenancy agreements and what the law means for landlords in England. To reclaim a property to sell or move into, you must use Section 8 with four months notice, and these grounds cannot be used during the first 12 months of a tenancy<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>pets and safety \u2013<\/strong> tenants have a legal right to request a pet (which you cannot unreasonably refuse), and agreements must now include summaries of safety obligations (gas safety, EICR, and Decent Homes Standard, for example)<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>fines for non-compliance \u2013 <\/strong>failure to provide the correct documents or continuing to use prohibited clauses (like blanket pet bans or fixed-terms) can result in local authority fines of up to \u00a37,000<\/li>\n<\/ul>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-end-of-the-fixed-term-tenancies-nbsp\">The end of the fixed-term tenancies&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Abolishing fixed-term tenancies and replacing them with assured periodic tenancies is a huge change for the private rented sector. Along with scrapping Section 21 evictions and changing the rules on keeping pets, here&#8217;s how the first phase of the Renters&#8217; Rights Act will impact tenancy agreements.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-this-means-from-1-may-nbsp\"><strong>What this means from 1 May <\/strong>&nbsp;<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">You can\u2019t include a fixed term of six or 12 months in your tenancy agreement. Any clause attempting to sign up a tenant for a set period will be legally void.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Notice periods are also affected as tenants will legally be able to end a tenancy at any time by giving two months\u2019 notice.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-happens-to-existing-tenancy-agreements\">What happens to existing tenancy agreements?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">While the Renters\u2019 Rights Act signals the end of fixed term tenancies, you don&#8217;t necessarily need to rip up your existing one on 1 May. Faye Schneider, Principal Associate Solicitor at ARAG Law said:&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere\u2019s no need to do anything with your current written agreements. For agreements that aren\u2019t in writing, landlords may want to formalise agreements before the reforms come into effect. However, we recommend that advice is taken before entering into any new agreements. For oral tenancies, there will be a requirement for landlords to provide a written statement of terms to tenants within a month of commencement of the Act.\u201d<\/p>\n\n\n\n<div class=\"wp-block-group has-azure-300-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-69910985 wp-block-group-is-layout-constrained\" style=\"border-radius:10px;padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--90);padding-bottom:var(--wp--preset--spacing--50);padding-left:var(--wp--preset--spacing--90)\">\n<p class=\"wp-block-paragraph\">Any fixed-term tenancies will automatically convert into an assured periodic tenancy by law.<\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-new-written-statement-of-terms\">The new written statement of terms<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Under the Act, it\u2019s now a legal requirement to provide tenants with a written statement of terms before a tenancy begins. While this can form part of your tenancy agreement, it must contain specific prescribed information which the government has outlined.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the latest government draft, your agreement must now explicitly include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>core details \u2013 <\/strong>full names of all landlords and tenants, the property address, and the date the tenant is first entitled to possession<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>financials details \u2013<\/strong> the rent amount, when it\u2019s due, and the deposit amount<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>rent increases \u2013<\/strong> a statement confirming any future rent increases will only be made with a <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/section-13-rent-increase\/\">Section 13 notice<\/a> (limited to once a year and capped at market rates)<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>bills and utilities \u2013<\/strong> a clear breakdown of any utilities that are included in the rent and any that are the tenant&#8217;s responsibility<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>possession grounds \u2013<\/strong> a statement explaining that you can only end the tenancy through a court order using valid legal grounds (such as selling or moving back in)<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-issue-an-information-sheet-by-31-may\">Issue an information sheet by 31 May<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If you have a written fixed-term tenancy in place,<strong> <\/strong>you must provide your tenants with a <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-news\/renters-rights-act-information-sheet\/\">government-produced information sheet<\/a> by 31 May 2026. This explains your tenants\u2019 new rights under the Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Faye Schneider stressed the importance of sharing the new documentation with your tenants. She said: &#8220;It&#8217;s crucial that all landlords and agents are aware of the requirement to provide the information sheet, because failure to do so could result in fines being imposed&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the tenancy agreement is verbal<strong>,<\/strong> you must provide the full written statement of terms (as described above) by 31 May 2026. Any old clauses in current tenancy agreements, like blanket bans on pets or rent reviews will become unenforceable.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-mandatory-clauses-from-1-may-pets-and-safety\">Mandatory clauses from 1 May \u2013 pets and safety<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Renters\u2019 Rights Act introduces implied terms that must be respected, even if they aren&#8217;t written into your existing agreement. These implied terms are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>the right to a pet \u2013<\/strong> tenants now have a legal right to <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/tenants\/renting-with-pets-guide-for-landlords\/\">request a pet<\/a>. You can\u2019t unreasonably refuse this request, but you can require the tenant to buy pet insurance to cover potential damage<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>safety summaries \u2013<\/strong> your written statement must now include a summary of your obligations regarding <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/gas-safety-certificate\/\"><strong>gas safety<\/strong><\/a>,<a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/landlord-electrical-safety\/\"> <strong>Electrical Safety (EICR)<\/strong><\/a>, and the <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/decent-homes-standard\/\"><strong>Decent Homes Standard<\/strong><\/a><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-new-possession-grounds-the-new-section-8\"><strong>New possession grounds \u2013 the new Section 8<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">With Section 21 evictions being abolished, you\u2019ll need to use a <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/what-is-a-section-8-notice\/\">Section 8<\/a> notice if you need the property back. However, you can only use a Section 8 in certain circumstances:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>selling or moving back into your property \u2013<\/strong> you can evict a tenant if you or a family member wants to move in, or if you intend to sell. However, these grounds can\u2019t be used during the first 12 months of a new tenancy, and you must provide four months\u2019 notice<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>rent arrears \u2013<\/strong> the mandatory threshold for rent arrears has increased from two months to three months, and the notice period has doubled from two weeks to four weeks<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-penalties-for-non-compliance\"><strong>Penalties for non-compliance<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The government is taking enforcement seriously. If you fail to do the following, you could be fined up to \u00a37,000 by your local authority:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">share the required written statement or information sheet by the 31 May deadline&nbsp;<\/li>\n\n\n\n<li class=\"wp-block-list-item\">stop using old terms that include prohibited clauses like fixed terms, blanket bans on pets, or rent review clauses<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-group has-azure-300-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-69910985 wp-block-group-is-layout-constrained\" style=\"border-radius:10px;padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--90);padding-bottom:var(--wp--preset--spacing--50);padding-left:var(--wp--preset--spacing--90)\">\n<p class=\"wp-block-paragraph\"><strong>Property law is a complex subject and not following the rules could result in a fine. You don&#8217;t need to re-issue them, but you must provide an official information sheet to your tenant by 31 May 2026.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-when-will-the-government-s-information-sheet-be-available\">When will the government&#8217;s information sheet be available<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The government has confirmed it will publish the official Information Sheet online in March 2026. Once available, you have until 31 May 2026 to provide it to existing tenants with written agreements.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-when-do-landlords-need-to-inform-tenants-of-the-new-rules\"><strong>When do landlords need to inform tenants of the new rules?<\/strong><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">For new tenancies starting from 1 May 2026, you must provide the required terms before the tenants sign.
