{"id":36072,"date":"2025-05-13T09:49:01","date_gmt":"2025-05-13T09:49:01","guid":{"rendered":"https:\/\/www.simplybusiness.co.uk\/?post_type=knowledge&#038;p=36072"},"modified":"2025-06-16T14:53:25","modified_gmt":"2025-06-16T14:53:25","slug":"awaabs-law-for-private-landlords","status":"publish","type":"knowledge","link":"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/awaabs-law-for-private-landlords\/","title":{"rendered":"Awaab\u2019s Law \u2013 new rules on hazards for private landlords"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A new law will introduce time limits for private landlords to respond to potential hazards in rental properties.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Awaab\u2019s Law will be introduced for social landlords from October 2025 and will be extended to the private rental sector as part of the Renters\u2019 Rights Bill.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-awaab-s-law\">What is Awaab\u2019s Law?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.gov.uk\/government\/news\/awaabs-law-to-force-landlords-to-fix-dangerous-homes\" target=\"_blank\" rel=\"noreferrer noopener\" rel=\"noopener noreferrer\" target=\"_blank\">Awaab\u2019s Law<\/a> will require landlords to fix and investigate dangerous <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/property-maintenance\/how-to-get-rid-of-mould-in-your-rental-property\/\" data-type=\"knowledge\" data-id=\"1244\" >damp and mould<\/a> in a set time period. They\u2019ll also be required to repair all emergency hazards within 24 hours.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new law is named after Awaab Ishak, who tragically died aged two after being exposed to damp and mould in social housing for a prolonged period.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law was introduced as part of the <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2023\/36\" target=\"_blank\" rel=\"noreferrer noopener\" rel=\"noopener noreferrer\" target=\"_blank\">Social Housing (Regulation) Act<\/a> following a campaign by Awaab Ishak\u2019s parents, housing charity Shelter, and The Manchester Evening News.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-awaab-s-law-summary-what-do-landlords-need-to-do\">Awaab\u2019s Law summary \u2013 what do landlords need to do?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Awaab\u2019s law is being introduced in the social housing sector in three stages between 2025 and 2027, before being rolled out to the private rented sector as part of the <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/renters-rights-bill\/\" data-type=\"knowledge\" data-id=\"25235\" >Renters\u2019 Rights Bill<\/a>.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here\u2019s what landlords will need to do:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>stage one (October 2025) \u2013<\/strong> address damp and mould hazards within a fixed timescale, and address all emergency repairs as soon as possible and within no longer than 24 hours<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>stage two (2026) \u2013 <\/strong>address a wider range of hazards (yet to be confirmed) within fixed timescales. This is likely to include excess cold and heat, hygiene hazards, structural collapse, and electrical hazards&nbsp;<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>stage three (2027) \u2013<\/strong> address all hazards defined by the Housing Health and Safety Rating System (HHSRS) within fixed timescales<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s important to note that the government is yet to release full details of how Awaab\u2019s Law will be applied to private rental properties.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Housing Minister Matthew Pennycook has confirmed that the government will consult on how to apply Awaab\u2019s Law to privately rented homes.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, it\u2019s likely to be similar to how it will apply to social housing.<\/p>\n\n\n\n<div id=\"nba-body-001\">\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-who-does-awaab-s-law-apply-to\">Who does Awaab\u2019s Law apply to?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Awaab\u2019s Law will initially apply to social landlords, and later apply to private landlords.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law will only apply to landlords in England.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-when-does-awaab-s-law-start\">When does Awaab\u2019s Law start?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The first stage of Awaab\u2019s Law will apply to social landlords from <strong>October 2025<\/strong>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From 2026, it will be extended to cover a wider range of hazards beyond damp and mould (yet to be confirmed) in the social housing sector.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From 2027, it will be extended further to apply to all hazards in social housing defined by the HHSRS (except overcrowding).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There\u2019s currently no date for when Awaab\u2019s Law will apply to private rental properties. It will be introduced as part of the Renters\u2019 Rights Bill, which is still being reviewed in the House of Lords.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s been suggested that the Renters\u2019 Rights Bill could receive Royal Assent and become law before the end of July 2025.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, new laws may not be enforced until later in the year or even 2026.
