A simple guide for landlords"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">If a landlord breaks the law, the tenant can apply to recoup up to 12 months of their rent. This is known as a rent repayment order (RRO).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The vast majority of landlords don\u2019t have to worry about RROs, but it\u2019s important to be aware of the <a href=\"#lack\">most common causes and how to avoid them<\/a>. There are also changes to rent repayment orders expected as part of the upcoming Renters\u2019 Rights Bill.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-a-rent-repayment-order\">What is a rent repayment order?\u00a0<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Rent repayment orders give tenants and local authorities the powers to take action against landlords who break tenancy laws.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Landlords who are found guilty by an independent tribunal can be ordered to return thousands of pounds of rent they\u2019ve been paid.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">RROs have been around since 2004, but it wasn\u2019t until measures were introduced as part of the Housing and Planning Act 2016 that tenants were able to use them.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-does-a-rent-repayment-order-work\">How does a rent repayment order work?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Tenants can apply for a rent repayment order to recover up to 12 months\u2019 rent from their landlord. To apply, the tenant has to pay a fee which they can recover if their case is successful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The application can be made against a landlord for an offence committed in the previous 12 months.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The tenant has to apply to the First-Tier Tribunal (FTT) for a RRO. The tribunal must be satisfied beyond reasonable doubt that the landlord has committed the offence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rent repayment order guidance states that the landlord doesn\u2019t need to have been criminally convicted for the offence for the tenant to apply for a rent repayment.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FTT will also award legal costs. These are likely to be awarded in favour of the tenant, unless their RRO claim is unfounded.&nbsp;<\/p>\n\n\n\n<div id=\"nba-body-001\">\n<\/div>\n\n<p class=\"wp-block-paragraph\">Local authorities can also apply for an RRO if a tenants\u2019 rent is paid using housing benefit or Universal Credit.<\/p>\n\n\n\n<div class=\"wp-block-group has-azure-200-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-30c80bf8 wp-block-group-is-layout-constrained\" style=\"border-radius:35px;margin-top:var(--wp--preset--spacing--90);margin-bottom:var(--wp--preset--spacing--90);padding-top:var(--wp--preset--spacing--90);padding-right:var(--wp--preset--spacing--90);padding-bottom:var(--wp--preset--spacing--90);padding-left:var(--wp--preset--spacing--90)\">\n<h2 class=\"wp-block-heading\" id=\"h-what-can-rent-repayment-orders-be-claimed-for\">What can rent repayment orders be claimed for?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There are several offences made by landlords for which tenants can apply for a rent repayment order. These include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">harassing a tenant<\/li>\n\n\n\n<li class=\"wp-block-list-item\">illegally evicting a tenant<\/li>\n\n\n\n<li class=\"wp-block-list-item\">breaching a banning order<\/li>\n\n\n\n<li class=\"wp-block-list-item\">failing to comply with an improvement notice<\/li>\n\n\n\n<li class=\"wp-block-list-item\">failing to comply with a prohibition order<\/li>\n\n\n\n<li class=\"wp-block-list-item\">renting an unlicensed <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/hmo-properties-everything-landlords-need-to-know\/\" data-type=\"knowledge\" data-id=\"993\" >house in multiple occupation (HMO)<\/a><\/li>\n\n\n\n<li class=\"wp-block-list-item\">using threatening or violent behaviour to <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/tenants\/guide-to-landlord-access-rights\/\" data-type=\"knowledge\" data-id=\"1013\" >enter a property<\/a><\/li>\n<\/ul>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-changes-to-rent-repayment-orders-under-the-renters-rights-bill\">Changes to rent repayment orders under the Renters\u2019 Rights Bill<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The government has outlined a number of changes to rent repayment orders as part of the <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/renters-rights-bill\/\" data-type=\"knowledge\" data-id=\"25235\" >Renters\u2019 Rights Bill<\/a> that\u2019s currently making its way through parliament.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The maximum amount a tenant can claim, and the period in which the offence was committed, will be doubled to 24 months.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And with the aim of penalising repeat offenders, landlords will be required to pay the maximum RRO if they commit the same offence again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The list of offences that a tenant can apply for a rent repayment order for will also be expanded to include:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">recklessly or knowingly misusing a <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/what-is-a-section-8-notice\/\" data-type=\"knowledge\" data-id=\"1570\" >possession ground<\/a><\/li>\n\n\n\n<li class=\"wp-block-list-item\">supplying false information to the Private Rented Sector Database<\/li>\n\n\n\n<li class=\"wp-block-list-item\">breaching restrictions on letting or marketing a dwelling-house<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">And if landlords are fined for the following offences and continue to break the rules, they could be ordered to repay tenants\u2019 rent for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">failing to register with the Private Rented Sector Database\u00a0<\/li>\n\n\n\n<li class=\"wp-block-list-item\">breaching tenancy reforms\u00a0<\/li>\n\n\n\n<li class=\"wp-block-list-item\">breaching landlord redress scheme regulations<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-innocence-of-law-is-no-defence-for-landlords-who-break-the-rules\">\u201cInnocence of law\u201d is no defence for landlords who break the rules<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Landlords should be aware that failing to know the laws they need to follow isn\u2019t seen as a defence for being ordered to repay rent.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This follows the <a href=\"https:\/\/www.landlordzone.co.uk\/news\/legal-case-rent-repayment-orders-honesty-the-best-policy\" target=\"_blank\" rel=\"noreferrer noopener\" rel=\"noopener noreferrer\" target=\"_blank\">Leibel v Baird<\/a> case from 2021. A landlord\u2019s tenant realised the property, which had five occupants, didn\u2019t have an HMO licence. At first, the landlord claimed only four tenants lived at the property and that he wasn\u2019t aware it would need a licence.\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It then became clear that he had been receiving rent payments from five tenants and was ordered to repay rent due to his breach of the law. After trying to mislead the tribunal, the landlord was ordered to pay a rent repayment order of over \u00a35,000 as well as costs of over \u00a320,000.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"lack\">Lack of licence common cause of rent repayment orders<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The most common example of landlords being ordered to repay rent is for failing to have the correct licence.<\/p>\n\n\n\n<div class=\"wp-block-group has-azure-300-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-69910985 wp-block-group-is-layout-constrained\" style=\"border-radius:10px;padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--90);padding-bottom:var(--wp--preset--spacing--50);padding-left:var(--wp--preset--spacing--90)\">\n<p class=\"wp-block-paragraph\">Here are some high-profile rent repayment order cases for licence failures:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">a London landlord was ordered to pay \u00a318,660 in rent repayments to four former tenants for failing to licence their property (February 2022)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">a London landlord was ordered to refund tenants \u00a320,000 in rent and pay a \u00a32,500 fine for failing to licence their HMO (December 2023)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">a student accommodation company in Oxford was ordered to refund \u00a384,000 in rent for failing to licence an HMO (September 2022)<\/li>\n<\/ul>\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">If you rent out an HMO, it\u2019s highly likely you\u2019ll need a licence.
