With this in mind, it\u2019s important to deal with any noise complaints as quickly as possible.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Read on for more information on neighbour noise complaints from renters, complaints about your tenants, and how to reduce the impact of noise in a property.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-are-the-most-common-causes-of-noise-complaints\">What are the most common causes of noise complaints?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A noise complaint could be made for any kind of disturbance that someone thinks is unreasonable.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here are some of the most common reasons people complain about noise:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/tenants\/renting-with-pets-guide-for-landlords\/\" data-type=\"knowledge\" data-id=\"22507\">noisy animals<\/a><\/li>\n\n\n\n<li class=\"wp-block-list-item\">regular parties with loud music&nbsp;<\/li>\n\n\n\n<li class=\"wp-block-list-item\">loud music or television late into the night<\/li>\n\n\n\n<li class=\"wp-block-list-item\">regular use of loud equipment or appliances<\/li>\n\n\n\n<li class=\"wp-block-list-item\">loud renovation or construction work outside of reasonable hours<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">To be considered for a noise complaint, these things would need to:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">disturb someone\u2019s comfort, such as preventing them from sleeping<\/li>\n\n\n\n<li class=\"wp-block-list-item\">happen repeatedly over a long period of time<\/li>\n\n\n\n<li class=\"wp-block-list-item\">occur at an unreasonable time, such as early in the morning or late at night (noise complaint hours are generally considered to be between 11pm and 7am)<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-noisy-neighbours-law-what-do-landlords-need-to-know\">Noisy neighbours law \u2013 what do landlords need to know?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When it comes to noise nuisance law, everyone is entitled to live in their home without suffering from excessive noise that disturbs their day-to-day life.&nbsp;<\/p>\n\n\n\n<div id=\"nba-body-001\">\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">As a landlord, this means you have a duty to protect tenants from noisy neighbours and other excessive noise where possible (this is also covered by the \u2018right to quiet enjoyment\u2019 in the Housing Act 1988).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a neighbour complains about noise being made by your tenants, it isn\u2019t your direct responsibility to resolve the problem but it\u2019s likely to be in your interest.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also known as \u2018noisy neighbours law\u2019, noise complaints are covered by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">The Environmental Protection Act 1990<\/li>\n\n\n\n<li class=\"wp-block-list-item\">The Noise and Statutory Nuisance Act 1993<\/li>\n\n\n\n<li class=\"wp-block-list-item\">The Noise Act 1996<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Noise complaints can lead to noise abatement orders issued by environmental health officers. These require those who are the subject of the complaint to stop making the excessive noise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the problem persists, it could lead to court action, fines of up to \u00a35,000, as well as <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/what-is-a-section-8-notice\/\" data-type=\"knowledge\" data-id=\"1263\">antisocial behaviour<\/a> orders and police involvement.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-happens-if-your-tenants-make-a-neighbour-noise-complaint\">What happens if your tenants make a neighbour noise complaint?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If a tenant complains about excessive noise, the landlord isn\u2019t legally obliged to resolve the problem. If the problem persists and a formal complaint is made, there\u2019s a higher chance they won\u2019t want to stay in the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You can <a href=\"https:\/\/www.gov.uk\/report-noise-pollution-to-council\" rel=\"noopener noreferrer\" target=\"_blank\">report a noise complaint<\/a> through the government website or directly to your local council.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-happens-if-you-receive-a-noise-complaint-about-your-tenants\">What happens if you receive a noise complaint about your tenants?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If someone makes a noise complaint about your tenants, you\u2019re not directly liable. Good neighbours can also alert you to any issues and monitor the property when it\u2019s empty.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-to-reduce-the-impact-of-noise-in-a-rental-property\">How to reduce the impact of noise in a rental property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Here are some of the things you can do to reduce the chances of noise complaints being made by or against your tenants:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>include a noise clause in the <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/tenants\/assured-shorthold-tenancy-agreement\/\" data-type=\"knowledge\" data-id=\"1325\">tenancy agreement<\/a><\/strong> \u2013 prohibit excessive noise between specific hours, such as 11pm and 7am<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>install soundproofing<\/strong> \u2013 this can reduce the impact of noise both ways.
