But the law around pets in rental properties isn\u2019t straightforward.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are some grey areas around how enforceable a blanket ban on pets is and what the consequences are for tenants having a pet without permission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And the Renters\u2019 Rights Bill is set to significantly change tenants\u2019 rights when it comes to having a pet at a rental property, potentially making it easier for them to keep pets.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Can a landlord refuse pets?&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Landlords have the right to refuse pets at their rental property. There\u2019s nothing in the law saying they have to allow pets and it\u2019s within their rights to have a blanket ban on pets in their tenancy agreement.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the moment, tenancy law doesn\u2019t include a lot of information about pets. But the government has made it clear that landlords should consider all requests for pets, whether they accept them or not.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And the Competition and Markets Authority (CMA) has stated that tenancy agreements that include a blanket ban on pets may not stand up in court.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whether or not the tenancy agreement includes a ban on pets, landlords can reject a request from a tenant to keep one. But that\u2019s all set to change with the <a href=\"https:\/\/bills.parliament.uk\/bills\/3764\" rel=\"noopener noreferrer\" target=\"_blank\">Renters\u2019 Rights Bill<\/a>.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Renters\u2019 Rights Bill and renting with pets&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Encouraging pet ownership is a central part of the government\u2019s <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/renters-rights-bill\/\" data-type=\"knowledge\" data-id=\"25235\">Renters\u2019 Reform Bill<\/a>. If the bill becomes law, landlords won\u2019t be able to reject a pet request from a tenant so easily.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the Renters\u2019 Rights Bill is passed, pet ownership in rental properties will change by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">landlords no longer being able to issue blanket bans on pets in their tenancy agreements&nbsp;<\/li>\n\n\n\n<li class=\"wp-block-list-item\">tenants will have the right to ask permission to have a pet at the property&nbsp;<\/li>\n\n\n\n<li class=\"wp-block-list-item\">landlords have to consider requests for pets and cannot \u2018unreasonably\u2019 refuse&nbsp;<\/li>\n\n\n\n<li class=\"wp-block-list-item\">tenants have the right to challenge a landlord\u2019s decision if they refuse their request\u00a0<\/li>\n\n\n\n<li class=\"wp-block-list-item\">landlords have 42 days to answer a tenant\u2019s request for a pet but it can be extended by an extra week if a landlord requests more information<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-group has-azure-200-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-30c80bf8 wp-block-group-is-layout-constrained\" style=\"border-radius:35px;margin-top:var(--wp--preset--spacing--90);margin-bottom:var(--wp--preset--spacing--90);padding-top:var(--wp--preset--spacing--90);padding-right:var(--wp--preset--spacing--90);padding-bottom:var(--wp--preset--spacing--90);padding-left:var(--wp--preset--spacing--90)\">\n<h3 class=\"wp-block-heading\" id=\"h-government-plans-to-remove-insurance-requirement\">Government plans to remove insurance requirement<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In the original version of the Renters\u2019 Rights Bill, it said that landlords would be able to require tenants to get insurance that covers damage caused by pets. Alternatively, tenants would be able to cover the cost of landlords taking out insurance themselves.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, as part of the report stage in the House of Lords, the government has tabled an amendment to the bill to remove this requirement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is despite the government saying in January 2025 that the insurance clause would \u201cprovide landlords with reassurance that any damage caused by a pet can be taken care of, and that the responsibility for preventing and resolving damage caused by a pet will fall to the tenant.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the amendment to remove the requirement for insurance is approved, it will be very difficult for landlords to protect themselves against potential wear and tear or damage caused by pets.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The only measure they could take is to increase the rent (in line with rules set out in the Renters\u2019 Rights Bill) as they can\u2019t increase the security deposit due to the Tenant Fees Act.<\/p>\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-how-will-landlords-respond-to-new-rules-on-pets-in-lets\">How will landlords respond to new rules on pets in lets?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In our <a href=\"https:\/\/www.simplybusiness.co.uk\/resources\/landlord-report\/\">Landlord Report<\/a>, we surveyed over a 1,000 landlords to understand their biggest challenges.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We asked about how changes to pet rules could impact the rental market. Here\u2019s what they had to say:&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex has-2-columns\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<div class=\"wp-block-cover has-aspect-ratio\" style=\"min-height:234px;aspect-ratio:1;min-height:unset;\"><span aria-hidden=\"true\" class=\"wp-block-cover__background has-background-dim-0 has-background-dim\" style=\"background-color:#4632d8\"><\/span><img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"300\" class=\"wp-block-cover__image-background wp-image-26949\" alt=\"\" src=\"https:\/\/www.simplybusiness.co.uk\/wp-content\/uploads\/sites\/3\/2024\/11\/Circles-01.png\" data-object-fit=\"cover\" srcset=\"https:\/\/www.simplybusiness.co.uk\/wp-content\/uploads\/sites\/3\/2024\/11\/Circles-01.png 300w, https:\/\/www.simplybusiness.co.uk\/wp-content\/uploads\/sites\/3\/2024\/11\/Circles-01.png?resize=150,150 150w, https:\/\/www.simplybusiness.co.uk\/wp-content\/uploads\/sites\/3\/2024\/11\/Circles-01.png?resize=96,96 96w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><div class=\"wp-block-cover__inner-container has-global-padding is-layout-constrained wp-block-cover-is-layout-constrained\">\n<p class=\"has-text-align-center wp-block-paragraph\" style=\"margin-bottom:0;font-size:100px\"><strong>63%<\/strong><\/p>\n<\/div><\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-vertically-aligned-center is-layout-flow wp-block-column-is-layout-flow\">\n<p class=\"wp-block-paragraph\">thought landlords would <strong>increase rent <\/strong>to cover the higher risk of property damage<\/p>\n<\/div>\n<\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">54 per cent were concerned about the increased risk of property damage<\/li>\n\n\n\n<li class=\"wp-block-list-item\">31 per cent thought landlords who don\u2019t want to accept pets would sell up and leave the market<\/li>\n\n\n\n<li class=\"wp-block-list-item\">53 per cent thought landlords would need to do more <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/tenants\/landlord-inspection-checklist-for-buy-to-let-property\/\" data-type=\"knowledge\" data-id=\"1234\">inspections<\/a> and tighten up their tenancy contracts<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Can landlords charge higher deposits for tenants with pets?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The reason many landlords don\u2019t accept pets is due to the increased risk of property damage caused by animals.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One way that landlords who do accept pets get around this issue is by charging a higher deposit, which can be deducted at the end of a tenancy if required.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, it\u2019s important to note that since 2019, deposits have been capped at five weeks\u2019 rent. This means in many cases the deposit may not be high enough to cover pet damage.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An alternative solution is to charge a higher \u2018pet rent\u2019 to remain compliant with the <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/tenants\/letting-agent-fees-for-landlords\/\" data-type=\"knowledge\" data-id=\"1477\">Tenant Fees Act<\/a>. However, it\u2019s a tricky balance to strike as higher rents could discourage tenants from making an offer.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What happens if a tenant keeps a pet without permission?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If your tenant is keeping a pet without your permission or they have a pet which is damaging the property or causing problems for neighbours, it\u2019s likely they\u2019ll be breaking their tenancy agreement. This means you may be able to evict them using a <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/what-is-a-section-8-notice\/\" data-type=\"knowledge\" data-id=\"1570\">Section 8 notice<\/a>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, eviction should always be a last resort so it\u2019s worth speaking to the tenant first to try and find a solution. You may be able to claim the costs from any damage caused by an unauthorised pet from the deposit at the end of the tenancy.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>What if a tenant needs an assistant or support animal?<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If a tenant requires an assistance animal such as a guide dog, the landlord is expected to make a \u2018reasonable adjustment\u2019 to allow them.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If they don\u2019t, this could be deemed as discriminatory behaviour that goes against the requirements of the <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/staff\/worker-protection-act\/\" data-type=\"knowledge\" data-id=\"1585\">Equality Act 2010<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Landlords and pets \u2013 what are the pros and cons?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Although some landlords are against pets, others are happy for their tenants to keep animals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Below are some of the reasons why landlords could be for or against pets in lets.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Advantages of allowing pets<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>a higher number of potential tenants \u2013<\/strong> with just seven per cent of landlords advertising pet-friendly properties in 2021, there\u2019s clearly a gap in the market for landlords who accept pets. A wider pool of tenants gives you more choice on who rents your property and a higher chance of letting it quickly<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>happier tenants and longer tenancies \u2013<\/strong> being able to keep a pet is likely to improve a tenant\u2019s happiness. The happier the tenant, the longer they\u2019re likely to stay in your property. This means more stability and lower overheads for the landlord<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>a better relationship with tenants \u2013<\/strong> if your tenants know you trust them to keep a pet, this could improve your relationship. As a result, they could be more likely to look after your property and alert you to problems quickly&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>opportunity for increased returns \u2013<\/strong> again, with only a small number of landlords accepting pets, tenants may be willing to pay more to secure a pet-friendly property. A higher rental price could put your mind at ease that you\u2019re covered for the increased risk of property damage<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Disadvantages of allowing pets<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>property damage \u2013 <\/strong>the main concern for most landlords about accepting pets is that they\u2019ll cause damage to the property which will cost money to fix<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>odours and hair \u2013 <\/strong>whether it\u2019s scratch marks, stains, or nasty smells, pets can have a long-term impact on a property. A landlord may have to organise extra cleaning when the tenancy ends and future tenants could be put off by the previous presence of animals<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>allergies \u2013<\/strong> the long lasting impact of pets in rental properties, such as difficult to remove hair, means that future tenants with a pet allergy could be affected<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>noise complaints \u2013<\/strong> animals can be noisy and anti-social, which could lead to complaints or disputes with neighbours that the landlord has to deal with<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>3 tips for allowing pets in your property<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Landlords will still be able to deny pet requests if they have a good reason, but potential rental reforms could make it much easier for tenants to keep pets in the future.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With this in mind, it could be beneficial to think about the steps you can take to allow pets while minimising the risk to your property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As well as getting comprehensive pet damage insurance to cover your property against pet damage, here are three things you could do:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">If possible, arrange to meet the pet before accepting the request.
