Under Section 11, you must keep the following in good repair:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">the structure and exterior of the property (walls, roof, foundations, drains, gutters, and external pipes)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">installations for supplying water, gas, and electricity<\/li>\n\n\n\n<li class=\"wp-block-list-item\">heating and hot water systems<\/li>\n\n\n\n<li class=\"wp-block-list-item\">sanitation (basins, sinks, baths, and drainage)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the shared or common areas of a property<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These obligations apply to most residential tenancies. You can&#8217;t contract out of them \u2013 even if a tenancy agreement says otherwise, the legal duty remains with you.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"gas\">Gas safety<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You must arrange an <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/gas-safety-certificate\/\" type=\"knowledge\" id=\"1280\">annual gas safety check<\/a> carried out by a Gas Safe registered engineer. This applies to all gas appliances, fittings, and flues you provide.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After each check, you&#8217;ll receive a Gas Safety Record (sometimes called a CP12 certificate). You must:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">give a copy to existing tenants within 28 days of the check<\/li>\n\n\n\n<li class=\"wp-block-list-item\">give a copy to new tenants before they move in<\/li>\n\n\n\n<li class=\"wp-block-list-item\">keep records for at least two years<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Failing to comply is a criminal offence under the Gas Safety (Installation and Use) Regulations 1998.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"electrical\">Electrical safety<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Since 1 April 2021, all landlords in England must have a valid <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/landlord-electrical-safety\/\" type=\"knowledge\" id=\"1470\">Electrical Installation Condition Report (EICR)<\/a>. This must be carried out by a qualified electrician at least every five years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You must provide a copy of the EICR to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">new tenants before they move in<\/li>\n\n\n\n<li class=\"wp-block-list-item\">existing tenants within 28 days of the inspection<\/li>\n\n\n\n<li class=\"wp-block-list-item\">your local authority within seven days if requested<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the report identifies urgent remedial work, you must complete it within 28 days (or sooner if specified). Keep a copy of the report and any completion certificates.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"epc\">Energy Performance Certificates (EPCs)<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Your rental property must have an <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/what-is-an-epc-rating\/\" type=\"knowledge\" id=\"989\">EPC rating<\/a> of at least Band E. Renting out a property with an F or G rating is illegal, unless you have a valid exemption registered on the PRS Exemptions Register.<\/p>\n\n\n\n<div class=\"wp-block-group has-azure-300-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-69910985 wp-block-group-is-layout-constrained\" style=\"border-radius:10px;padding-top:var(--wp--preset--spacing--20);padding-right:var(--wp--preset--spacing--90);padding-bottom:var(--wp--preset--spacing--50);padding-left:var(--wp--preset--spacing--90)\">\n<p class=\"wp-block-paragraph\"><strong>What&#8217;s changing:<\/strong> The government is raising the minimum EPC requirement to Band C by 2030 for all tenancies. This is still subject to final legislation, but it&#8217;s worth planning ahead \u2013 especially if your property currently has a lower rating.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The government has also confirmed that the EPC system will be <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/energy-efficiency-rules-for-rental-properties-scrapped\/\" type=\"knowledge\" id=\"1381\">overhauled in 2026<\/a>, introducing new ways of measuring performance.&nbsp; It will now be based on how properties retain heat rather than how much energy a property uses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You can check your property&#8217;s current EPC rating on the <a href=\"https:\/\/www.gov.uk\/find-energy-certificate\" target=\"_blank\" rel=\"noreferrer noopener\" rel=\"noopener noreferrer\" target=\"_blank\">government&#8217;s EPC register<\/a>.<\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"fire\">Fire safety<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Your fire safety responsibilities depend on the type of property you let.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For all rented properties in England, you must:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">install at least one smoke alarm on every storey used as living accommodation<\/li>\n\n\n\n<li class=\"wp-block-list-item\">install a carbon monoxide alarm in any room with a fixed combustion appliance (such as a gas boiler or wood-burning stove)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">repair or replace alarms once a tenant reports they&#8217;re faulty<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For houses in multiple occupation (HMOs), additional fire safety requirements apply, including fire doors, fire extinguishers, and emergency lighting. Check with your local authority for specific requirements.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"damp\">Damp, mould, and Awaab&#8217;s Law<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Dealing with damp and <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/property-maintenance\/how-to-get-rid-of-mould-in-your-rental-property\/\" type=\"knowledge\" id=\"1244\">mould<\/a> is one of the most common \u2013 and most serious \u2013 maintenance issues landlords face. You&#8217;re legally required to address it promptly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Homes (Fitness for Human Habitation) Act 2018 requires you to make sure your property is fit to live in at the start of the tenancy and throughout. Serious damp and mould can make a property unfit for habitation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/awaabs-law-for-private-landlords\/\" type=\"knowledge\" id=\"36072\">Awaab&#8217;s Law<\/a> \u2013 named after two-year-old Awaab Ishak, who died in 2020 due to prolonged exposure to mould in a social housing property \u2013 was originally introduced for social housing. Under the <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/landlord-regulation\/renters-rights-bill\/\" type=\"knowledge\" id=\"25235\">Renters&#8217; Rights Act<\/a>, it&#8217;s being extended to the private rented sector.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means private landlords will be required to investigate and fix reported hazards (including damp and mould) within set timeframes. The specific timescales for the private rented sector will be set out in secondary legislation, so watch for updates.<\/p>\n\n\n\n<div id=\"nba-body-001\">\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"decent\">Renters&#8217; Rights Act 2025: Decent Homes Standard<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For the first time, the Decent Homes Standard \u2013 previously only applicable to social housing \u2013 will apply to private rented properties. Your property must:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">be free from serious hazards (assessed under the Housing Health and Safety Rating System, or HHSRS)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">be in a reasonable state of repair<\/li>\n\n\n\n<li class=\"wp-block-list-item\">have reasonably modern facilities<\/li>\n\n\n\n<li class=\"wp-block-list-item\">have effective insulation and heating<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"structure\">Maintaining the structure and exterior of a property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Keep your property safe, comfortable, and compliant with these straightforward maintenance checks. While not always legally required, keeping on top of these can help you avoid costly repairs down the line.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Roofing<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>inspect seasonally \u2013 <\/strong>check your roof in spring and autumn to catch minor issues before they grow<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>clear debris \u2013 <\/strong>remove moss, algae, and gutter blockages to prevent rot and freezing damage<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>fix damage \u2013 <\/strong>repair broken tiles, slates, and gaps around chimneys<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">External walls<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>spot check for leaks \u2013 <\/strong>look for cracks, damaged rendering, and damp stains<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>clear drains \u2013 <\/strong>keep external drains clean to avoid flooding<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>monitor for <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/property-maintenance\/what-is-subsidence\/\" type=\"knowledge\" id=\"1584\">subsidence<\/a> \u2013 <\/strong>watch for deep cracks that indicate the ground beneath the property is sinking<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Windows and doors<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>maintain security \u2013 <\/strong>make sure all external doors and windows close and lock securely to keep your tenants safe<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>weatherproof \u2013 <\/strong>keep fixtures damp-proof, draught-proof, and free of mould<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>repair wear and tear \u2013 <\/strong>replace broken panes and damaged elements caused by normal use<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Pipes and plumbing<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>check for leaks \u2013 <\/strong>look for damp patches or puddles under sinks, baths, and toilets<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>prevent freezing \u2013 <\/strong><a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/property-maintenance\/frozen-pipes-guide-for-landlords\/\" type=\"knowledge\" id=\"1389\">monitor pipes during cold snaps<\/a> to stop them from bursting under pressure<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Heating and hot water<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>meet legal standards \u2013 <\/strong>make sure living rooms can reach 21 degrees (18 degrees for bedrooms) and tenants have constant access to hot water. Treat any loss of heating or hot water as a 24-hour emergency<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>service annually \u2013<\/strong> <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/property-maintenance\/landlord-boiler-service-and-maintenance\/\">service your boiler every year<\/a> and bleed the radiators<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>guide your tenants \u2013 <\/strong>ask tenants to monitor boiler pressure, test the heating in summer, and <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/property-maintenance\/prepare-your-property-for-winter\/\" type=\"knowledge\" id=\"1591\">keep the property heated during winter<\/a> to prevent frozen pipes<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Garden maintenance<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>landlord responsibilities \u2013 <\/strong>maintain areas of the garden that would be unreasonable to expect a tenant to handle, or might need the help of a professional, such as maintaining trees and large shrubs, or making sure climbing plants don\u2019t grow too large \u2013 plus keep an eye out for <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/property-maintenance\/japanese-knotweed-a-guide-for-landlords\/\" type=\"knowledge\" id=\"1291\">Japanese Knotweed<\/a><\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>tenant responsibilities \u2013<\/strong> basic upkeep such as mowing the lawn, removing rubbish and keeping the garden tidy, removing weeds, and keeping smaller shrubs in check<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"access\">Access to your rental property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You can&#8217;t enter your rental property whenever you like. You must <a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/tenants\/guide-to-landlord-access-rights\/\" type=\"knowledge\" id=\"1013\">give your tenant at least 24 hours&#8217; written notice<\/a> before visiting \u2013 except in a genuine emergency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a legal requirement under common law and forms part of your tenant&#8217;s right to &#8216;quiet enjoyment&#8217; of the property. Entering without notice could be considered harassment.<\/p>\n\n\n\n<div class=\"wp-block-group has-azure-200-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-30c80bf8 wp-block-group-is-layout-constrained\" style=\"border-radius:10px;margin-top:var(--wp--preset--spacing--90);margin-bottom:var(--wp--preset--spacing--90);padding-top:var(--wp--preset--spacing--90);padding-right:var(--wp--preset--spacing--90);padding-bottom:var(--wp--preset--spacing--90);padding-left:var(--wp--preset--spacing--90)\">\n<h2 class=\"wp-block-heading\" id=\"what-happens\">What happens if you don&#8217;t meet your responsibilities?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Failing to meet your maintenance and legal responsibilities can have serious consequences, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>improvement notices<\/strong> from your local authority<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>civil penalties<\/strong> (up to \u00a330,000 for certain offences)<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>prosecution<\/strong> and a criminal record<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>rent repayment orders<\/strong> \u2013 tenants can apply to the First-tier Tribunal to reclaim up to 12 months&#8217; rent<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>banning orders<\/strong> \u2013 in serious cases, you can be banned from letting properties<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"h-\">The Renters&#8217; Rights Act has also strengthened enforcement powers for local authorities, so the risk of action is increasing.<\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"maintenance\">Property maintenance: redecorating and cleaning<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Now we\u2019ve covered the basics of property maintenance, there are a few other ways you\u2019ll need to take care of your property to protect your investment and keep tenants happy.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Redecorating your rental property&nbsp;<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">There\u2019s no fixed time scale or legal requirement for how often you need to r<a href=\"https:\/\/www.simplybusiness.co.uk\/knowledge\/property-maintenance\/how-often-should-a-landlord-redecorate\/\" type=\"knowledge\" id=\"1409\">edecorate your rental property<\/a>.
