This can help to make sure that rent and costs for damages are paid even when tenants aren\u2019t able to pay.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are circumstances when it makes sense to require a guarantor, including when renting to students or young professionals.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, introducing guarantors into the rental agreement adds a layer of complexity, from guarantor agreements to extra affordability checks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So, when and why might you need your tenants to provide a guarantor and how could the process change as a result of the Renters\u2019 Rights Act?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-a-rental-guarantor\">What is a rental guarantor?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A rent guarantor is someone who can pay rent when the tenant can\u2019t. The guarantor will usually be liable for other payments too, like property damage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They may also need to meet the tenant\u2019s other obligations and responsibilities if things go wrong.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Guarantors give landlords extra security, but you need to check that they would actually be able to pay.<\/p>\n\n\n\n<div class=\"wp-block-group has-azure-200-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-30c80bf8 wp-block-group-is-layout-constrained\" style=\"border-radius:10px;margin-top:var(--wp--preset--spacing--90);margin-bottom:var(--wp--preset--spacing--90);padding-top:var(--wp--preset--spacing--90);padding-right:var(--wp--preset--spacing--90);padding-bottom:var(--wp--preset--spacing--90);padding-left:var(--wp--preset--spacing--90)\">\n<h2 class=\"wp-block-heading\" id=\"h-when-and-why-are-guarantors-needed\">When and why are guarantors needed?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Many landlords ask tenants to provide a guarantor if they\u2019re a student or young professional, while some ask all tenants to provide one as policy.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here are some of the other reasons why a tenant might need a guarantor:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><strong>lack of (or poor) references<\/strong> \u2013 previous landlord references can show that a tenant usually pays their rent on time and full<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>low income or failed affordability check<\/strong> \u2013 this could be an indication that the tenant may struggle to meet their monthly rent payments&nbsp;<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>limited, non-existent, or poor credit history<\/strong> \u2013 a strong credit score shows that someone is able to keep up with their Direct Debits and pay off debts<\/li>\n\n\n\n<li class=\"wp-block-list-item\"><strong>unstable or irregular employment<\/strong> \u2013 freelancers or self-employed people may have busy and leaner periods of working, meaning there could be months where they don\u2019t have enough money to pay rent if they don\u2019t budget effectively<\/li>\n<\/ul>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-who-can-be-a-guarantor\">Who can be a guarantor?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Guarantors should be in stable long-term employment and are usually UK homeowners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As there\u2019s a high level of trust involved, the guarantor will often be a close relative. For instance, students usually ask a parent to be their guarantor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From a landlord\u2019s perspective, you need to check the guarantor in the same way you <a data-type=\"knowledge\" data-id=\"977\" href=\"\/knowledge\/tenants\/a-landlords-guide-to-choosing-a-tenant\/\">check tenants<\/a>. That means credit searches and referencing, as well as asking for these details on the application form:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">identity and personal details<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the property they\u2019re agreeing to be guarantor for<\/li>\n\n\n\n<li class=\"wp-block-list-item\">legal history<\/li>\n\n\n\n<li class=\"wp-block-list-item\">employment history<\/li>\n\n\n\n<li class=\"wp-block-list-item\">residency information<\/li>\n\n\n\n<li class=\"wp-block-list-item\">references (a character reference from an accountant or lawyer)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">bank reference<\/li>\n\n\n\n<li class=\"wp-block-list-item\">agreement that you can do a credit search, plus signature<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">You should also draw up a proper guarantor agreement. As there\u2019s no standard or statutory guarantor agreement, it\u2019s important that the wording is right for all parties.<\/p>\n\n\n\n<div id=\"nba-body-001\">\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-goes-in-the-guarantor-agreement\">What goes in the guarantor agreement?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The guarantor\u2019s agreement is with the landlord (and separate to the tenancy agreement). It includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">the date of the agreement<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the lease term the agreement applies to (and how the guarantor\u2019s obligations end)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the names of the guarantor and the landlord (and their signatures)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the property details<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the tenant\u2019s name<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The guarantor agreement needs to be clear about the guarantor\u2019s responsibilities and obligations. However, fixed term tenancies are being abolished and replaced with periodic tenancies that have no end date.
