If you\u2019re not entitled to Statutory Sick Pay (SSP), there are other sickness benefits that you could be entitled to.<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\"><a href=\"#sspfortheselfemployeddoesitexist\">can I get sick pay when self-employed?<\/a><\/li>\n\n\n\n<li class=\"wp-block-list-item\"><a href=\"#sickpayforselfemployedrateslimitedcompanydirectors\">sick pay for self-employed limited company directors&nbsp;<\/a><\/li>\n\n\n\n<li class=\"wp-block-list-item\"><a href=\"#istheresicknessbenefitforselfemployedsoletradersandpartners\">sick pay for self-employed sole traders and partners<\/a><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"sspfortheselfemployeddoesitexist\">Can I get sick pay when self-employed?<\/h2>\n\n<p class=\"wp-block-paragraph\">In most cases, the self-employed are unable to claim for many of the benefits that employees are entitled to \u2013 including statutory sick pay (SSP).<\/p>\n\n<p class=\"wp-block-paragraph\">SSP is a payment to employees when they\u2019re off sick for an extended period of time.<\/p>\n\n<p class=\"wp-block-paragraph\">As <a href=\"\/business-insurance\/self-employed-insurance\/\">self-employed insurance<\/a> doesn&#8217;t offer protection for sickness and ill health, it&#8217;s worth looking into whether you can claim SSP. Self-employed eligibility for SSP depends on the <a href=\"\/knowledge\/starting-out\/sole-trader-vs-limited-company\/\" data-type=\"knowledge\" data-id=\"1532\" >legal structure of a business<\/a>.<\/p>\n\n<p class=\"wp-block-paragraph\">That\u2019s because if you\u2019re a <strong>limited company director<\/strong> you\u2019re an employee of your limited company. This means you\u2019re entitled to SPP at the same rates as your employees.<\/p>\n\n<p class=\"wp-block-paragraph\">If you\u2019re a <strong>sole trader<\/strong> or in a <strong>partnership<\/strong> you can\u2019t claim SSP, but there are other self-employed sickness benefits that you might be able to claim for.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"sickpayforselfemployedrateslimitedcompanydirectors\">Sick pay for self-employed limited company directors<\/h2>\n\n<p class=\"wp-block-paragraph\">Limited company directors are employees, so they can claim SSP through their business.<\/p>\n\n<p class=\"wp-block-paragraph\">The usual <a href=\"\/knowledge\/staff\/ssp-rate-how-much-is-statutory-sick-pay\/\" data-type=\"knowledge\" data-id=\"1222\" >SSP rate<\/a> applies. In 2024-25 the SSP rate is \u00a3116.75 a week for up to 28 weeks.<\/p>\n\n<p class=\"wp-block-paragraph\">If you\u2019re off work sick as a limited company director, you need to follow the SSP rules. You have to have been off work for four or more days in a row, including non-working days. Days when you\u2019re meant to be working but are off sick are known as \u2018qualifying days\u2019.<\/p>\n\n<div id=\"nba-body-001\">\n<\/div>\n\n<p class=\"wp-block-paragraph\">The first three days you\u2019re sick are known as \u2018waiting days\u2019. You\u2019re entitled to SSP from the fourth day you\u2019re off sick.<\/p>\n\n<p class=\"wp-block-paragraph\">You need to earn an average salary of at least \u00a3123 a week to qualify for SSP.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"istheresicknessbenefitforselfemployedsoletradersandpartners\">Sick pay for for self-employed sole traders and partners<\/h2>\n\n<p class=\"wp-block-paragraph\">While sole traders and partners can\u2019t claim SSP, there\u2019s a number of <a href=\"\/knowledge\/allowances\/benefits-and-self-employed-minimum-income-floor\/\" data-type=\"knowledge\" data-id=\"1331\" >benefits the self-employed might be entitled to<\/a>.<\/p>\n\n<p class=\"wp-block-paragraph\">The one that could cover self-employed illness is <strong>Employment and Support Allowance (ESA)<\/strong>. You might be entitled to weekly ESA payments if you have a longer-term illness or disability that means you\u2019re unable to work.<\/p>\n\n<p class=\"wp-block-paragraph\">You also need to be:<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">16 or over<\/li>\n\n\n\n<li class=\"wp-block-list-item\">under the State Pension age<\/li>\n\n\n\n<li class=\"wp-block-list-item\">live in England, Wales or Scotland<\/li>\n\n\n\n<li class=\"wp-block-list-item\">not claiming Job Seekers\u2019 Allowance (JSA)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">paying enough National Insurance contributions (<a href=\"https:\/\/www.gov.uk\/check-national-insurance-record\" rel=\"noopener noreferrer\" target=\"_blank\">check your National Insurance record at gov.uk<\/a>)<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">While there are different types of ESA that people can claim for, most will claim \u2018new style\u2019 ESA. For this, you need to have been an employee or self-employed over the last two to three years. You also need to have two full tax years of National Insurance contributions (or one year of contributions and one year of National Insurance credits).<\/p>\n\n<p class=\"wp-block-paragraph\">You can apply for \u2018new style\u2019 ESA online at gov.uk or over the phone. You need your:<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">proof that you have limited capability for work (fit note)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">National Insurance number<\/li>\n\n\n\n<li class=\"wp-block-list-item\">bank or building society account number and sort code<\/li>\n\n\n\n<li class=\"wp-block-list-item\">GP\u2019s details<\/li>\n\n\n\n<li class=\"wp-block-list-item\">income details if you\u2019re working<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Citizens Advice says that the Department for Work and Pensions (DWP) might tell you that you should claim for self-employed Universal Credit too, but you don\u2019t need to do this for \u2018new style\u2019 ESA. You shouldn\u2019t feel pressured to apply for benefits you\u2019re not sure about.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"sickpayforselfemployedrateswhenclaimingesa\">Sick pay for self-employed rates when claiming ESA<\/h3>\n\n<p class=\"wp-block-paragraph\">Citizens Advice says that if the DWP accepts your claim, you\u2019ll get your first payments a few weeks after your claim. Your payments will usually be backdated by up to three months, to cover time when you had limited capability to work. You won\u2019t be able to claim payments for the first seven days you were unable to work.<\/p>\n\n<p class=\"wp-block-paragraph\">When you first claim for \u2018new style\u2019 ESA or contribution-based ESA, you\u2019ll usually get:<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">\u00a390.50 each week (aged 25 or over)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">\u00a371.70 each week (aged under 25)<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">After three months, the DWP will assess you. You\u2019ll then be put into one of two groups.&nbsp; If you\u2019re able to get back into work in the future, you\u2019ll be put into something called the work-related activity group. Otherwise, you\u2019ll be put into the support group.&nbsp;<\/p>\n\n<p class=\"wp-block-paragraph\">Each group has a different rate:<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">up to \u00a390.50 a week (if you\u2019re able to go back to work and put in the work-related activity group)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">up to \u00a3138.20 a week (if you\u2019re not able to go back to work and put in the support group)<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">If you\u2019re in the support group and on income-related ESA, you\u2019re also entitled to the <a href=\"https:\/\/www.gov.uk\/disability-premiums\/what-youll-get\" rel=\"noopener noreferrer\" target=\"_blank\">enhanced disability premium<\/a>, and may qualify for the severe disability premium.
