It sets out all the key information of the tenancy, such as when the rent\u2019s due and who\u2019s responsible for maintenance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Read on to find out what your tenancy agreement should include, why you need one, and how to make sure it complies with the law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is an assured shorthold tenancy agreement?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A tenancy agreement in the UK is a contract between a landlord and their tenants, which sets out the legal terms and conditions of the tenancy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Most tenancy agreements will automatically be assured shorthold tenancy (AST) agreements, also known as an assured shorthold tenancy agreement for letting a residential dwelling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They\u2019ll likely be this type of tenancy agreement if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">you&#8217;re a private landlord or housing association<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the tenancy began on or after 15 January 1989<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the property is your tenants\u2019 main residence<\/li>\n\n\n\n<li class=\"wp-block-list-item\">you don\u2019t live in the property<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A tenancy <strong>can\u2019t<\/strong> be an assured shorthold tenancy agreement if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">it started before 15 January 1989<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the rent is in excess of \u00a3100,000 a year<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the rent is lower than \u00a3250 a year (lower than \u00a31,000 if the property is in London)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">it&#8217;s a business or licensed premises<\/li>\n\n\n\n<li class=\"wp-block-list-item\">it\u2019s a holiday let<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the landlord is a local council<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"howlongisanassuredshortholdtenancyagreement\">How long is an assured shorthold tenancy agreement?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">An assured shorthold tenancy is an agreement between the landlord and tenant that lasts for a minimum of six months.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An AST can have a set term, such as six months or 12 months, or it can be periodic. A periodic tenancy is a rolling agreement between the landlord and tenant with no fixed end date.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The different types of tenancy agreement<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Assured shorthold tenancies are the most common type of tenancy. Under s54(2) of the Law of Property Act 1925, a tenancy will exist as soon as a tenant starts paying rent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, having a written tenancy agreement allows you to make certain stipulations, such as how and when you\u2019ll review rent or the circumstances under which you may withhold all or part of your tenant&#8217;s deposit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Without a written agreement you won\u2019t even be able to prove how much rent the tenant owes you, and may find yourself caught out.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What to include in an assured shorthold tenancy agreement<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There are a number of things that you can include in a tenancy agreement, such as: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">the names of everyone involved in the agreement<\/li>\n\n\n\n<li class=\"wp-block-list-item\">how much the rent will be<\/li>\n\n\n\n<li class=\"wp-block-list-item\">how often the rent will be paid<\/li>\n\n\n\n<li class=\"wp-block-list-item\">how much the deposit will be<\/li>\n\n\n\n<li class=\"wp-block-list-item\">reasons you may withhold all or part of the deposit<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the address of the property<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the start date and length of the tenancy<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the tenants&#8217; An assured shorthold tenancy notice period must be set out in your tenancy agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You could also receive an assured shorthold tenancy notice to quit by the tenant which means they want to leave the property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your assured shorthold tenancy agreement notice period must fit in with legal guidelines.
