At first glance, an invasive plant might not seem a major concern.<\/p>\n\n<p class=\"wp-block-paragraph\">But if left unchecked, it can have severe repercussions both financially and legally. Here&#8217;s everything landlords need to know about Japanese Knotweed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-japanese-knotweed\">What is Japanese Knotweed?<\/h2>\n\n<p class=\"wp-block-paragraph\">Known for its rapid growth, Japanese Knotweed is an invasive plant that&#8217;s notoriously hard to get rid of. This plant has distinctive heart-shaped leaves, bamboo-like stems, and clusters of small white flowers.<\/p>\n\n<p class=\"wp-block-paragraph\">Its roots can grow to a depth of two metres and its foliage is dense. It\u2019s become very unpopular with both tenants and landlords and it causes problems that aren\u2019t always straightforward to solve.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-why-is-japanese-knotweed-bad-for-landlords\">Why is Japanese Knotweed bad for landlords?<\/h2>\n\n<p class=\"wp-block-paragraph\">Property damage is the main concern for landlords when dealing with Japanese Knotweed. Japanese Knotweed is much easier to eradicate if identified early, so it\u2019s useful for landlords to be able to spot it.<\/p>\n\n<p class=\"wp-block-paragraph\">But even if it\u2019s grown out of control, there are ways to remove it effectively. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-japanese-knotweed-removal\">Japanese Knotweed removal <\/h2>\n\n<p class=\"wp-block-paragraph\">Removing Japanese Knotweed from your property isn\u2019t straightforward. Effectively eradicating it yourself is complex \u2013 practically and legally. <\/p>\n\n<p class=\"wp-block-paragraph\">If you need to get rid of Japanese Knotweed, you have three options: <\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">dig deep into the ground and remove the root <\/li>\n\n\n\n<li class=\"wp-block-list-item\">use a chemical weed killer <\/li>\n\n\n\n<li class=\"wp-block-list-item\">seek professional help <\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">If you decide to remove Japanese Knotweed yourself, using a chemical weedkiller is the simplest option. A glyphosate-based weedkiller is the most effective at getting to the root of the weed. <\/p>\n\n<p class=\"wp-block-paragraph\">It usually takes three to four seasons to completely eradicate Japanese Knotweed with a weedkiller as it tends to regrow the following spring with a very different appearance. <\/p>\n\n<p class=\"wp-block-paragraph\">A small leafy bush will grow in its place the following spring and it\u2019s essential you remove this until it doesn&#8217;t return.   <\/p>\n\n<p class=\"wp-block-paragraph\">If you\u2019d prefer to dig up the Japanese Knotweed, you\u2019ll need to dig at least one metre deep and remove all the roots and <a href=\"https:\/\/www.britannica.com\/science\/rhizome\" rel=\"noopener noreferrer\" target=\"_blank\">rhizomes<\/a>. <\/p>\n\n<p class=\"wp-block-paragraph\">You then need to take precautions when you dispose of it. Japanese Knotweed has to go to a licensed landfill. You can contact the <a href=\"https:\/\/www.gov.uk\/government\/publications\/treatment-and-disposal-of-invasive-non-native-plants-rps-178\/treatment-and-disposal-of-invasive-non-native-plants-rps-178#contact\" rel=\"noopener noreferrer\" target=\"_blank\">Environment Agency<\/a> and they\u2019ll let you know where to go.    <\/p>\n\n<p class=\"wp-block-paragraph\">This is why many landlords choose to seek professional help as it reduces the chance of it coming back and you won\u2019t have to handle the disposal of it. <\/p>\n\n<p class=\"wp-block-paragraph\">Property Care Association has a <a href=\"https:\/\/www.property-care.org\/homeowners\/invasive-weed-control\" rel=\"noopener noreferrer\" target=\"_blank\">list of licensed contractors<\/a> that can remove Japanese Knotweed from your property.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-legal-considerations\">Legal considerations<\/h2>\n\n<p class=\"wp-block-paragraph\">If there\u2019s Japanese Knotweed at one of your properties, there are some legal implications for landlords to be aware of.<\/p>\n\n<p class=\"wp-block-paragraph\">When you or your tenant find Japanese Knotweed on your property, your <a href=\"\/knowledge\/tenants\/assured-shorthold-tenancy-agreement\/\" data-type=\"knowledge\" data-id=\"1325\" >tenancy agreement<\/a> will state whose responsibility it is to remove it. <\/p>\n\n<p class=\"wp-block-paragraph\">But acting quickly is important when dealing with Japanese Knotweed, so you may want to take on the responsibility yourself. Especially to avoid any potential damage to your property. <\/p>\n\n<p class=\"wp-block-paragraph\">When disposing of Japanese Knotweed, you need to take care as it&#8217;s classified as \u2018controlled waste\u2019. Under the <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1990\/43\/contents\" rel=\"noopener noreferrer\" target=\"_blank\">Environmental Protection Act 1990<\/a>, it\u2019s an offence to incorrectly dispose of Japanese Knotweed and you could unintentionally break the law. <\/p>\n\n<p class=\"wp-block-paragraph\">If you\u2019re selling a property, you\u2019re legally required to check for Japanese Knotweed and add it to the property information form when it\u2019s found. It\u2019s an offence to not share this information if you\u2019re aware of it. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-insurance-and-mortgages\">Insurance and mortgages<\/h2>\n\n<p class=\"wp-block-paragraph\">Because of the risks to your property when removing Japanese Knotweed, landlords need to consider their insurance before deciding what to do. <\/p>\n\n<p class=\"wp-block-paragraph\">If you, your tenant, or an unqualified gardener decide to remove the Knotweed without professional assistance, you may compromise your <a href=\"https:\/\/www.simplybusiness.co.uk\/landlord-insurance\/building-insurance\/\">property&#8217;s insurance<\/a>.<\/p>\n\n<p class=\"wp-block-paragraph\">If you were to manually remove Japanese Knotweed from your property and <a href=\"https:\/\/www.simplybusiness.co.uk\/landlord-insurance\/accidental-damage\/\">unintentionally damage<\/a> some pipes or cause instability in a wall, there\u2019s a chance your insurance won\u2019t cover the costs. <\/p>\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.property-care.org\/homeowners\/invasive-weed-control\" rel=\"noopener noreferrer\" target=\"_blank\">Professional contractors<\/a> can offer insurance-backed guarantees on their work. This is a more expensive option but can provide peace of mind that your property is protected. <\/p>\n\n<p class=\"wp-block-paragraph\">Make sure you check your policy with insurer before removing Japanese Knotweed as some insurers have it listed as an exlusion. <\/p>\n\n<p class=\"wp-block-paragraph\">Mortgage lenders are less cautious than in the past when it comes to Japanese Knotweed because of improved methods of removing it. Lenders usually want to see a management plan that outlines how you\u2019ll effectively remove it from the property.<\/p>\n\n<p class=\"wp-block-paragraph\">This is where having an insurance-backed contractor may be useful as it\u2019s more reliable than a non-professional removing the Japanese Knotweed.
