But how much is SSP? Find out more about the SSP rate and your responsibilities when staff are off sick.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is Statutory Sick Pay (SSP)?<\/h2>\n\n<p class=\"wp-block-paragraph\">An employee may be eligible for Statutory Sick Pay if they\u2019re ill and can\u2019t work. They need to have been off work for four or more days in a row (including non-working days).<\/p>\n\n<p class=\"wp-block-paragraph\">The first three days are called \u2018waiting days\u2019 and you start paying SSP from the fourth \u2018qualifying day\u2019 (the day your employee is usually needed to work).<\/p>\n\n<p class=\"wp-block-paragraph\">A day doesn\u2019t count as a sick day if they&#8217;ve worked for more than a minute before they\u2019ve gone home ill.<\/p>\n\n<p class=\"wp-block-paragraph\">It\u2019s important to note that employees are entitled to statutory <a href=\"\/knowledge\/staff\/annual-leave-policy-template-free-download\/\" data-type=\"knowledge\" data-id=\"1323\" >annual leave<\/a> while they\u2019re off sick and they can take holiday while they\u2019re on sick leave (no matter how long they\u2019re off).<\/p>\n\n<p class=\"wp-block-paragraph\">Meanwhile, you can\u2019t force employees to take annual leave if they\u2019re eligible for sick leave.<\/p>\n\n<h3 class=\"wp-block-heading\">Employer sick pay schemes<\/h3>\n\n<p class=\"wp-block-paragraph\">The SSP rate is the legal minimum employers can pay staff when they\u2019re sick. However, you might have your own sick pay scheme, which lets you offer more than the standard SSP rate. <\/p>\n\n<p class=\"wp-block-paragraph\">If you have one, you should write it into your <a href=\"\/knowledge\/staff\/employment-contract-template\/\" data-type=\"knowledge\" data-id=\"1379\" >employees\u2019 contracts<\/a> and <a href=\"\/knowledge\/staff\/what-is-a-staff-handbook\/\" data-type=\"knowledge\" data-id=\"1058\" >staff handbook<\/a> (schemes like this are known as \u2018contractual\u2019 or \u2018occupational\u2019 sick pay).<\/p>\n\n<p class=\"wp-block-paragraph\">You should also record accurate details of your employee\u2019s absence and their sick pay payments.<\/p>\n\n<h2 class=\"wp-block-heading\">How much is Statutory Sick Pay?<\/h2>\n\n<p class=\"wp-block-paragraph\">You use the weekly SSP rate to calculate how much SSP to pay your employees.<\/p>\n\n<h3 class=\"wp-block-heading\">SSP rate in the UK<\/h3>\n\n<p class=\"wp-block-paragraph\">On <strong>6 April 2024<\/strong>, the SSP rate increased from <strong>\u00a3109.40 a week<\/strong> to <strong>\u00a3116.75 a week<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">The SSP rate is for <strong>up to 28 weeks of sick leave<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">You can use a daily SSP rate if your employee isn\u2019t off work for the whole week. The daily SSP rate depends on how many qualifying days your employee usually works and how many days they\u2019re off sick.<\/p>\n\n<div id=\"nba-body-001\">\n<\/div>\n\n<p class=\"wp-block-paragraph\">You can see the <a href=\"https:\/\/www.gov.uk\/guidance\/rates-and-thresholds-for-employers-2021-to-2022#statutory-sick-pay-ssp\" rel=\"noopener noreferrer\" target=\"_blank\">daily SSP rate at gov.uk<\/a>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"sspcalculator\">SSP calculator<\/h3>\n\n<p class=\"wp-block-paragraph\">Gov.uk has a <a href=\"https:\/\/www.gov.uk\/calculate-statutory-sick-pay\" rel=\"noopener noreferrer\" target=\"_blank\">Statutory Sick Pay calculator<\/a> you can use to work out how much to pay your employees who are off sick.<\/p>\n\n<p class=\"wp-block-paragraph\">Employers pay SSP in the same way they pay monthly wages \u2013 on the normal payday, including tax and National Insurance deductions.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-when-does-an-employee-qualify-for-statutory-sick-pay\"><strong>When does an employee qualify for Statutory Sick Pay?<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Gov.uk says that to qualify for SSP your employee should:<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">have an <a href=\"\/knowledge\/staff\/employment-contract-template\/\" data-type=\"knowledge\" data-id=\"1379\" >employment contract<\/a><\/li>\n\n\n\n<li class=\"wp-block-list-item\">have worked under the contract<\/li>\n\n\n\n<li class=\"wp-block-list-item\">have been ill for three or more days in a row, including non-working days<\/li>\n\n\n\n<li class=\"wp-block-list-item\">earn \u00a3123 a week on average (known as the lower earnings limit)<\/li>\n\n\n\n<li class=\"wp-block-list-item\">give you notice of their illness<\/li>\n\n\n\n<li class=\"wp-block-list-item\">give you proof of their illness after they\u2019ve had seven days off<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Acas (the Advisory, Conciliation and Arbitration Service) says that agency, casual and zero-hour employees can get SSP if they meet the eligibility criteria.<\/p>\n\n<p class=\"wp-block-paragraph\">As an employer, you can set a limit in which employees have to tell you they\u2019re sick. If you don\u2019t have one, it\u2019s automatically set at seven days.<\/p>\n\n<p class=\"wp-block-paragraph\">If the employee is late telling you they\u2019re sick without good reason, you don\u2019t have to pay SSP. For example if your limit is six days and the employee gives notice of their sickness after nine days, then you won\u2019t need to pay them SSP for the three days over the limit.<\/p>\n\n<h3 class=\"wp-block-heading\">Proof of illness: what is a fit note?<\/h3>\n\n<p class=\"wp-block-paragraph\">Employers can ask for a fit note, commonly known as a sick note, if their employee is off work for more than seven days in a row (including non-working days).<\/p>\n\n<p class=\"wp-block-paragraph\">A fit note must be issued by a healthcare professional, such as a:<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">GP or hospital doctor<\/li>\n\n\n\n<li class=\"wp-block-list-item\">pharmacist<\/li>\n\n\n\n<li class=\"wp-block-list-item\">registered nurse<\/li>\n\n\n\n<li class=\"wp-block-list-item\">physiotherapist<\/li>\n\n\n\n<li class=\"wp-block-list-item\">occupational therapist<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>Self certification form or SC2 form<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">Your employees can also use something called an SC2 form to ask you for Statutory Sick Pay. This can be used to self-certify an absence if you want your employee to let you know about their sickness in writing. However, your employee doesn\u2019t legally need to use this form.&nbsp;<\/p>\n\n<p class=\"wp-block-paragraph\">The form will ask the employee for:&nbsp;<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">their National Insurance number<\/li>\n\n\n\n<li class=\"wp-block-list-item\">their phone number<\/li>\n\n\n\n<li class=\"wp-block-list-item\">details of their illness and when they were unwell<\/li>\n\n\n\n<li class=\"wp-block-list-item\">the date of the last working day before their sickness began<\/li>\n\n\n\n<li class=\"wp-block-list-item\">their clock or payroll number<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">What are the exceptions for receiving SSP?<\/h3>\n\n<p class=\"wp-block-paragraph\">There are some exceptions that could mean your employee isn\u2019t eligible for sick pay. These include employees who\u2019ve already had the maximum 28 weeks of SSP and employees who are getting Statutory Maternity Pay (there are different rules in this situation).<\/p>\n\n<p class=\"wp-block-paragraph\">Other reasons employees may not be eligible for sick pay include:<\/p>\n\n<ul class=\"wp-block-list\">\n<li class=\"wp-block-list-item\">if they\u2019re off work for a pregnancy-related illness in the four weeks before the week (Sunday to Saturday) that their baby is due<\/li>\n\n\n\n<li class=\"wp-block-list-item\">if they received Employment and Support Allowance within 12 weeks of starting or returning to work for you<\/li>\n\n\n\n<li class=\"wp-block-list-item\">if they\u2019re working outside the EU and you\u2019re not required to pay their National Insurance contributions<\/li>\n\n\n\n<li class=\"wp-block-list-item\">if they were on strike or in custody on the first day of sickness<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n<p class=\"wp-block-paragraph\">But if a series of linked periods lasts more than three years, employees aren\u2019t eligible for SSP.<\/p>\n\n<p class=\"wp-block-paragraph\">Read more about <a href=\"https:\/\/www.gov.uk\/employers-sick-pay\/eligibility-and-form-ssp1\" rel=\"noopener noreferrer\" target=\"_blank\">SSP eligibility and the exceptions <\/a>at gov.uk.<\/p>\n\n<h3 class=\"wp-block-heading\">Statutory Sick Pay form SSP1<\/h3>\n\n<p class=\"wp-block-paragraph\">If your employee isn\u2019t eligible for SSP or their SSP is ending, they might be able to claim other <a href=\"\/knowledge\/allowances\/benefits-and-self-employed-minimum-income-floor\/\" data-type=\"knowledge\" data-id=\"1331\" >other benefits<\/a> like Universal Credit and Employment and Support Allowance (ESA). You need to send these employees form <a href=\"https:\/\/www.gov.uk\/employers-sick-pay\/eligibility-and-form-ssp1\" rel=\"noopener noreferrer\" target=\"_blank\">SSP1<\/a> so they can claim these benefits.<\/p>\n\n<p class=\"wp-block-paragraph\">For employees who aren\u2019t entitled to SSP, you have to send them SSP1 within seven days of them taking time off sick.<\/p>\n\n<p class=\"wp-block-paragraph\">If an employee is receiving SSP but their situation changes and they no longer qualify, you have to send them SSP1 within seven days of their sick pay ending.
